WildCamp Terms of Service

These Terms of Service ("Terms") govern your use of the WildCamp mobile application and related services (the "Service"), provided by WxByte LLC, a Texas-registered business ("we", "us"). By creating an account or using the Service, you agree to be bound by these Terms.
WildCamp is not a substitute for on-the-ground judgment. Location data, road conditions, and regulations change frequently. Always verify with the relevant land manager, on-site signage, and current fire and weather conditions before traveling.
1. Eligibility
You must be at least 13 years old to use WildCamp. By creating an account, you represent that you meet this requirement.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
3. Acceptable Use
You agree not to:
Submit content that is unlawful, threatening, harassing, defamatory, obscene, or that infringes the rights of others.
Submit deliberately false or misleading information about locations, hazards, or access.
Submit locations on private property without the owner's permission, or on lands where camping is prohibited.
Use the Service to scrape, harvest, or mass-extract data, including via automated tools, without our written permission.
Attempt to interfere with, reverse engineer, or compromise the Service or any user's account.
Impersonate another person or misrepresent your affiliation.
Use the Service for commercial purposes (such as paid tour operations or commercial guiding) without our permission.
4. User Content
"User Content" includes reviews, ratings, photos, location submissions, and any other material you contribute through the Service.
4.1 You retain ownership
You retain ownership of your User Content. You are solely responsible for what you submit and confirm that you have the right to submit it.
4.2 License to us
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (e.g. resize photos), publish, publicly display, and distribute your User Content within the Service and for the purpose of operating, promoting, and improving the Service. This license terminates when you delete the content, except (a) for User Content that other users have already saved or referenced, and (b) for anonymized aggregate data and ratings.
4.3 Anonymization on account deletion
When you delete your account, your reviews and submitted locations remain visible to the community but are anonymized — your name is replaced with "Deleted user" and your uploaded photos are removed. This preserves the value of community ratings and contributions.
4.4 Moderation
We may remove, edit, or restrict access to User Content that we believe violates these Terms or is otherwise objectionable, in our sole discretion and without notice.
5. Disclaimers About Location Data
Information in WildCamp comes from public datasets (USFS, BLM, OpenStreetMap, Recreation.gov), other users, and partners. It is not authoritative. Roads may be closed, sites may be reserved, regulations may have changed, and conditions can be dangerous. Always:
Confirm road and area access with the local Forest Service or BLM office.
Check active fire restrictions and burn bans before lighting any fire.
Carry adequate water, navigation, and emergency communication.
Tell someone your itinerary and expected return.
Pack out everything you pack in. Follow Leave No Trace principles.
6. Subscriptions and Purchases
WildCamp offers an optional paid subscription ("WildCamp Pro") with additional features. Subscriptions are billed through the Apple App Store or Google Play according to their respective billing terms. By subscribing, you authorize the applicable store to charge you on a recurring basis until you cancel.
Manage or cancel your subscription through your App Store or Play Store account, not through us.
We do not process refunds directly. Refund requests must go through Apple or Google.
Pricing, features, and entitlements may change. Material changes apply to renewals, not the current paid term.
7. Intellectual Property
The Service, excluding User Content, is owned by WxByte LLC and protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes, subject to these Terms.
8. Third-Party Content and Links
The Service may include data from or links to third-party services (e.g. USFS land ownership data, weather forecasts, external map providers). We do not control these services and are not responsible for their accuracy or availability.
9. Termination
You may delete your account at any time via Settings → Account → Delete Account, or by emailing support@wxbyte.com. We may suspend or terminate your access if you violate these Terms or for any other reason. Provisions that by their nature should survive (e.g. licenses you grant in your User Content, disclaimers, limitations of liability) will survive termination.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE. WE MAKE NO WARRANTY REGARDING LOCATION DATA, ROAD CONDITIONS, REGULATIONS, OR THE SAFETY OF ANY SITE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WXBYTE LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING WITHOUT LIMITATION ANY INJURY, ILLNESS, PROPERTY DAMAGE, OR DEATH SUSTAINED IN CONNECTION WITH ANY TRIP OR LOCATION ACCESSED THROUGH THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $50.
12. Indemnification
You agree to indemnify and hold harmless WxByte LLC from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your User Content, or (c) your violation of these Terms or any law or third-party right.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted to this page with a new "Last Updated" date. Your continued use of the Service after changes take effect indicates acceptance.
